A Freedom of Information request to the Australian drugs regulator that approved the Pfizer vaccine confirms that they have never seen the study data
A freedom of information request (FOI) request was made by one of our members in February 2021 to the Australian drugs regulator, the TGA (Therapeutic Good Administration) to ask what should have been simple questions. The TGA is the Australian equivalent of the FDA (US), MHRA (UK) and EMA (Europe) and is held in high regard worldwide. Essentially the FOI questions were:
- Did the TGA request the raw data from Pfizer
- Did any of the committees approving the vaccine look at the raw data and/or discuss it
- What were the “studies” referred to in the approval document relating to teratogenicity (risk of harm to a fetus)
The rationale of the request relates to concern over the validity and verifiability of Pfizer’s data given its legal history (and expressed by Peter Doshi in the BMJ in February) as well as the proven concerns over fraudulent data relating to Covid-19 as seen in the “Lancetgate” scandal of June 2020.
The document below is a redacted version of the documents that were sent by the TGA in response to this request. What they show is that the TGA never saw or requested the patient data from Pfizer and simply accepted their reporting of their study as true. This means that when the head of the TGA John Skerritt said that “the safety evidence is pretty thorough” on the 6th February (here) his words would ring hollow to most Australians who have assumed, rightly or wrongly, that the TGA had actually looked at the patient data themselves.

Any law that purports to make it mandatory for a person to submit to a COVID-19 vaccination is invalid.
In 1945, the then Chief Justice Latham held that quarantine laws “may be regarded in most, if not all, of its aspects as a form of public health legislation”.
The Commonwealth has the power under section 51(ix) of the Constitution to make laws with respect to ‘quarantine’. This is a power granted to the Commonwealth. Not the States.
At [257] of the decision, Latham CJ held that the Commonwealth “could not pass a law requiring citizens of the States… to submit to vaccination or immunization”.
So there are several important things that flow from this High Court decision.
- Vaccinations and immunizations are matters that fall within the category of ‘quarantine’.
- Only the Commonwealth has the power to make laws with respect to ‘quarantine’ under section 51(ix) of the Constitution.
- The Commonwealth is prohibited from passing laws requiring citizens to submit to vaccination or immunization (which are quarantine matters).
- The States have no power to make laws with respect to quarantine, including matters dealing with vaccinations and immunizations (as Latham CJ held that these things are ‘quarantine’ matters).
- The States are unable to do something that the Commonwealth is prohibited from doing under the exercise of the quarantine power.
- Therefore the States cannot pass any law that requires citizens to submit to vaccination or immunization.
- Part 3B of the Public Health (COVID-19 Air Transportation Quarantine) Order (No 2) (NSW) 2021 is invalid.
All workers who have been identified under the ‘NSW Airport and Quarantine Workers’ Vaccination Program’ should consider the above before making any decision as to whether to have a COVID-19 vaccination.

Letter to a school withdrawing consent for covid jab of children
Dear Mr/Mrs
I am writing to you with to expressly forbid my child/children from being vaccinated for COVID 19 in the event that the Government implements a policy of doing so.
In the absence of parental consent, should the Government, vaccinator and/or school seek to apply the ‘Gillick Competency Test’ then I will submit the following:
- As of 18 May 2021, 33 Children between the ages of 10 and 19 have sadly died with COVID (1). However, as of 13 May 2021 there have been 374 reported deaths following the Pfizer Vaccine, 786 from the Oxford/Astra Zeneca (AZ) Vaccine and 4 from the Moderna Vaccine (2). It cannot therefore be argued that the benefits of COVID vaccines for children outweigh the risks. Of course, clinical trials regarding the efficacy the AZ Vaccine on children were paused following concerns relating to fatal blood clotting (*3).
- Participants of the Phase Ill trial will be monitored for a further 2 years (4). As such the phase Ill trial is not yet complete and accordingly, the long-term side effects are unknown. The Gillick Competency test requires that a child is advised on the potential risks and implications arising from ‘treatment'(5). It is not therefore possible to advise any lay person; let alone a child as to the potential side effects. As such the Gillick Test cannot be satisfied.
- Given the fact that the long-term side effects are unknown, children must be advised as to the potential long terms side effects such as Antibody Dependent Enhancement (ADE) (6) and Vaccine Associated Enhanced Disease (VAED) (7). These complex vaccine induced conditions are not easily comprehendible, particularly for children.
- Side effects from coronavirus vaccination are not without precedent. In 2009 6 million [mostly] children were vaccinated against the swine flu, many of whom suffered brain injury. As a result, the government were ordered to pay £60m in compensation.(*8)

This is not an exhaustive list but I trust that you understand my concerns regarding the ethical issues regarding consent and the potential unknown side effects. I fear that children will be killed and/or seriously injured by these vaccines and the benefit does not outweigh the potential harm. It should be borne in mind that the manufacturers of the vaccines have been granted immunity from liability for any harm caused by their vaccines (*9) Therefore any liability could fall on the government, the vaccinator or the school.
